Court overrules body corporate to prevent ban of pets


Recently, NSW Courts have prevented the ban of pets by body corporate at the famous Horizon apartment block in Sydney.

It was a unanimous decision from three Court of Appeal judges on The Horizon’s longstanding attempt to ban animals from the apartment block. The Court ruled that this was breach of legislation as it effectively change the way owners corporation can govern their strata schemes.

What this now means is it effects apartment holders across NSW.

“This ruling may have far wider ramifications as to the by-laws owners corporations can impose on apartment owners. This win could mean some significant changes and legal challenges to by-laws for years to come,” Ms Levy from Bartier Perry.
